To the Palin/HR 3200 provision on end-of-life counseling they talk about panel discussions on the definition of death. I have this vision of a room with a couple of tables, behind which sit men with mean faces and military uniforms. These are not Americans, by the way, so this death panel is somewhere else. There are armed guards at the doors, and the doors open, with more guards escorting in a small group of people at gunpoint.

One of the officers at the table shuffles some papers and reads off a charge of the people having violated some oppressive rule of the regime, perhaps having published critical articles about men with mean faces and military uniforms. Then the officer tells the people they are all sentenced to death, and the people start crying and cursing as their guards drag them away.

I'll admit I haven't read the entirety of HR 3200, but I haven't seen anything remotely like that scenario. I can believe such death panels happened in Nazi Germany or some oppressed Latin American country. I think it is a tremendous exaggeration to call the end-of-life counseling with a doctor a death panel. Sensitive people might feel pressured to forgo care or, if a patient is in a coma, perhaps the individual named to consider such matters in the patient's Living Will could be pressured to forgo further attempts to extend grandma's life.

Abuses of any power can be hypothesized to occur. However....the bill does put substantial authority into the government's hands instead of the insurance company's hands. So it is prudent, I think, to verify what powers the government is going to give itself.


DANGER!  From my reading, the bigger danger as far as a death panel comes from the powers of the Health Choices Commissioner (Sec. 203(a)) and the Health Benefits Advisory Committee (Sec. 123(a)&(b)):     DANGER!

HR3200 -Sec. 203(a):
"The Commissioner shall specify the benefits to be made available under Exchange-participating health benefits plans during each plan year..."
Sec. 123(a)): "There is established a private-public advisory committee which shall be a panel of medical and other experts to be known as the Health Benefits Advisory Committee to recommend covered benefits and essential, enhanced, and premium plans."

Sec 123(b) (1) "The Health Benefits Advisory Committee shall recommend to the Secretary of Health and Human Services (in this subtitle referred to as the ‘‘Secretary’’) benefit standards (as defined in paragraph (4)), and periodic updates to such standards. In developing such recommendations, the Committee shall take into account innovation in health care and consider how such standards could reduce health disparities."

Covered benefits (Sec 123(b)(4), "including categories of covered treatments, items and services within benefit classes, and cost-sharing"), meaning things like knee replacements and cancer treatments, will be determined by the Secretary of Health and Human Services, the Health Choices Commissioner (to be appointed by the President and confirmed by the Senate), and the Health Benefits Advisory Committee (to be appointed by the President [up to 17 people] and the Comptroller General [9 people], without confirmation).

There is obvious opportunity here for the Secretary, Commissioner, and Committee to recommend that some condition not be covered, such as dementia or other category-likely conditions. No one is going to pull the plug on grandma, but they could decide they just aren't going to pay for having her plugged in, at all. But let's assume that the conditions are officially covered. We aren't out of the woods yet.

Title IV, Section 2404, covers the implementation of best practices. It involves changing the Public Health Care Act, by inserting some new sections, including Part D, Section 931(h), which says that in general, "The Director shall enter into voluntary arrangements with health care providers (including hospitals and other health facilities and health practitioners) in a State or region to implement best practices identified or developed under this section." (by the Secretary).


The Director is defined in the Public Health Care Act, which I haven't looked up, but I believe the intent is that doctors will be informed of best practices but not required to use them, not even by having payment depend on having used them.
Voluntary guidelines can be ignored. If the doctors don’t agree with the treatments recommended, they will generally be inclined to ignore them.

Thus, no cost savings. Perhaps the government plans to incentivize the doctors by paying them more if they use the recommended treatments? That doesn’t sound like it would promote cost savings, even if doctors are all as greedy as the President has implied, so that they use whatever treatment enriches them the most genenally.

So if you have invested money in figuring out how to save money and then the recommendations are ignored, you have lost money. When this happens, what stops the government from taking steps to make the guidelines into requirements? To control costs, of course. To keep the health care financial burden from destroying the economy.

Once the guidelines are requirements, the door is open to the government making recommended treatment guidelines based on political considerations to reduce the number of people in a category that is, shall we say, inconvenient to have around. That would fit the definition of a death panel. It’s more impersonal and more efficient than what the phrase conjures up as a vision, but people would die as a result of the council’s decisions. People would die to save money.

The point is that the worst thing about the bill is that it gives government the power and authority to do terrible things. The bill contains fragile protections that could be overruled later with much less fanfare than the current bill has, when people have relaxed, thinking the fight is over. The only real safety is in keeping government out of the insurance business altogether.

No Commissioner, Committee, Exchange, best practices recommendations...just you, your doctor, and your insurance company. This doesn't mean there is no useful reform to be had. Coverage of pre-existing conditions and ensured portability are good reforms. Letting people buy insurance across state lines, while I don't think it will help much, is a reasonable choice. Rolling Medicare and Medicaid together and loosening the restrictions so anyone can sign up, and pay income-dependent premiums (so everyone has "skin in the game"), would amount to a public option but that's what Medicare and Medicaid already are.

If my insurance company denies me coverage for some treatment, and I survive, I might be able to find a different insurance company without having to leave the country. Where and how am I going to find another government?  I could sue an insurance company, but am I going to be able to sue the government? – Ritmore.

하지만 국내언론들은 Death Panel을 엉뚱하게 번역했다. 정부 공무원들로 구성된 '죽음의 위원회’라는 것이다. '죽음의 위원회'라고 번역하면 미국 노인들이 반발하는 기저에 깔린 뜻을 전달하기에는 부족하다. Death Panel을 다룬 언론보도를 살펴보자.

다음은 위키피디아에 실린 것으로 H.R.3200에 대한 설명이다. 이는 2009년 7월 14일 민주당이 하원에 발의한 의료보험개혁 법안이다. 이 법안 중에서 환자가 사망선택유언을 할 경우 카운셀링한 것에 대한 비용환급 문제를 다룬 Reimbursement for counseling about living wills을 보면 Death Panel과 관련된 설명이 나온다.

위 내용은 Death Panel을 둘러싼 논란을 설명한 것으로, Advance Care Planning Consultation(ACPC)을 법안에 넣은게 공화당과 로비스트 베스티 맥코이 등 보수주의자들의 공격 타깃이 되고 있다는 것이다. 법안의 세부내용을 살펴보면 ACPC는 환자와 의사 간에 이뤄진 상담으로 사망선택유언 등 향후 치료전반에 대한 내용을 포괄적으로 설명하고 있다.  

직역하면 '향후관리계획자문'인데 안락사 등 앞으로 어떻게 하는게 좋을지 환자에게 상담해주는 것을 말한다. 맥코이는 이를 두고 노인환자들에게 안락사를 강요하는 강제적인 조항이라고 공격했다. 2008년 대선때 공화당 부통령 후보였던 새라 페일린은 맥코이의 주장을 따라이 조항을 집중적으로 공격했다.

"나의 부모 또는 다운 증후군을 앓고 있는 나의 아들이 오바마의 Death Panel 앞에서 서야할 것이다."  요컨대 오바마의 의료개혁법이 실행되면 관료들이 사망여부를 결정하는 Death Panel을 구성하게 되고, 생산성이 떨어지는 사람들은 이 위원회에서 생사가 갈린다는 논리이다.  실제로 법안의 이 부분은 사망 선택유언 (Living Will)과 관련해 카운셀링을 한 의사에게도 진료비를 의료보험에서 지급토록 할 수 있도록 하는 내용이다.

Death Panel은 안락사 또는 존엄사를 결정하는 위원회에 가깝다. "사망선고 위원회"라고 말하는게 가장 근접한 번역이 될 듯하다.  생명위원회 또는 국가생명 윤리위원회라고 병기하면 그 속에 감춰진 뜻을 전달할 수 있다. 이 위원회는 의료 비용를 줄이기 위한 관료조직을 말하는게 아니다. 공화당이 생명윤리 문제를 다루는 조직의 설립에 대한 위기감을 확산시키기 위해 Death Panel이라는 것이다.

Thanks to the infinite wisdom of Sarah Palin, old people will have to pay costly bills before they die cursing their wretched suffering won't have to suffer at the hands of death anymore! Hurray!
  

Palin vs. Obama: Death Panels
On Aug. 12, 2009 Palin attempted to clear up her argument with a detailed Facebook post. Palin discussed Section 1233 and said that "it’s misleading for the President to describe this section as an entirely voluntary provision that simply increases the information offered to Medicare recipients." Palin goes onto argue:

Palin, Aug. 12: The issue is the context in which that information is provided and the coercive effect these consultations will have in that context. … These consultations are authorized whenever a Medicare recipient’s health changes significantly or when they enter a nursing home, and they are part of a bill whose stated purpose is “to reduce the growth in health care spending.” Is it any wonder that senior citizens might view such consultations as attempts to convince them to help reduce health care costs by accepting minimal end-of-life care?

The fact remains that the bill wouldn’t require patients to receive counseling sessions, nor would it require a doctor to offer one. Rather, it modifies Section 1861(s)2 of the Social Security Act, defining what services Medicare will pay for. So if a patient receives a counseling session from a doctor or health care practitioner, he or she doesn’t have to pay for it – Medicare will. As we pointed out in our earlier story, Medicare will also pay for prosthetic limbs, but that doesn’t mean that every recipient gets those, too.

And the concern that these sessions are "part of a bill whose stated purpose is ‘to reduce the growth in health care spending,’ " while true, is hardly the whole story. One of the bill’s other goals is to "provide affordable, quality health care for all Americans." The legislation is 1,017 pages long with sections that cut costs, some that increase care, and some that do both. In fact, the counseling sessions would add to government expenses since Medicare would have to reimburse doctors.

The nonpartisan Congressional Budget Office estimates officially that Section 1233 will cost a net total of $2.7 billion over 10 years. Furthermore, proposals to offer reimbursement for such counseling have attracted bipartisan support. Republican Sen. Johnny Isakson of Georgia, a sponsor of one such measure, gave an interview to the Washington Post on August 10, in which he discussed the benefits of these counseling sessions "both for the sanity of the family and what savings the family has." Isakson also commented on the recent confusion around the issue:

Isakson, Aug. 10: I just had a phone call where someone said Sarah Palin’s web site had talked about the House bill having death panels on it where people would be euthanized. How someone could take an end of life directive or a living will as that is nuts. You’re putting the authority in the individual rather than the government. I don’t know how that got so mixed up.

Palin also attempts to buttress her case by quoting some writings by Dr. Ezekiel Emanuel, a health policy adviser to the president. Here she’s echoing claims made elsewhere, twisting the meaning of Emanuel’s writings and taking them out of context. We examined those claims in an Ask FactCheck item we posted earlier today, and won’t repeat the details here.
Mr. Grassley said in a statement that he and others in the small group of senators that was trying to negotiate a health care plan had dropped any “end of life” proposals from consideration. A pending House bill has language authorizing Medicare to finance beneficiaries’ consultations with professionals on whether to authorize aggressive and potentially life-saving interventions later in life. Though the consultations would be voluntary, and a similar provision passed in Congress last year without such a furor, Mr. Grassley said it was being dropped in the Senate “because of the way they could be misinterpreted and implemented incorrectly.”

In an editorial, the newspaper reminded its readers of the Aktion T4 program of Nazi Germany in which “children and adults with disabilities, and anyone anywhere in the Third Reich was subject to execution who was blind, deaf, senile, retarded, or had any significant neurological condition.”

When the Democrats included money for family planning in a proposed version of the stimulus bill in January, the socially conservative George Neumayr wrote for the American Spectator: “Euthanasia is another shovel ready job for Pelosi to assign to the states. Reducing health care costs under Obama’s plan, after all, counts as economic stimulus, too — controlling life, controlling death, controlling costs.”

The legislation did not direct the coordinator to dictate doctors’ treatments. A separate part of the law — regarding a council set up to coordinate research comparing the effectiveness of treatments — states that the council’s recommendations cannot “be construed as mandates or clinical guidelines for payment, coverage or treatment.”

But Ms. McCaughey’s article provided another opportunity for others to raise the specter of forced euthanasia. “Sometimes for the common good, you just have to say, ‘Hey, Grandpa, you’ve had a good life,’ ” Mr. Beck said. The syndicated conservative columnist Cal Thomas wrote, “No one should be surprised at the coming embrace of euthanasia.”

The Washington Times editorial page reprised its reference to the Nazis, quoting the Aktion T4 program: “It must be made clear to anyone suffering from an incurable disease that the useless dissipation of costly medications drawn from the public store cannot be justified.”

But as Congress developed its legislation this summer, critics seized on provisions requiring Medicare financing for “end of life” consultations, bringing the debate to a peak. Still, one proponent of the euthanasia theory, Mr. Neumayr, said he saw no reason to stop making the claim. “I think a government-run plan that is administered by politicians and bureaucrats who support euthanasia is inevitably going to reflect that view,” he said.          -from Robert Pear

(계 2:10) Fear none of those things which thou shalt suffer: behold, the devil shall cast some of you into prison, that ye may be tried; and ye shall have tribulation ten days: be thou faithful unto death, and I will give thee a crown of life.

  

(계 3:5) He that overcometh, the same shall be clothed in white raiment; and I will not blot out his name out of the book of life, but I will confess his name before my Father, and before his angels.

(계 7:17) For the Lamb which is in the midst of the throne shall feed them, and shall lead them unto living fountains of waters: and God shall wipe away all tears from their eyes.

  

(계 12:11) And they overcame him by the blood of the Lamb, and by the word of their testimony; and they loved not their lives unto the death.

(계 13:8) And all that dwell upon the earth shall worship him, whose names are not written in the book of life of the Lamb slain from the foundation of the world.

  

  

(계 17:8) The beast that thou sawest was, and is not; and shall ascend out of the bottomless pit, and go into perdition: and they that dwell on the earth shall wonder, whose names were not written in the book of life from the foundation of the world, when they behold the beast that was, and is not, and yet is.

  

(계 20:12) And I saw the dead, small and great, stand before God; and the books were opened: and another book was opened, which is the book of life: and the dead were judged out of those things which were written in the books, according to their works.

(계 20:15) And whosoever was not found written in the book of life was cast into the lake of fire.

  

(계 21:6) And he said unto me, It is done. I am Alpha and Omega, the beginning and the end. I will give unto him that is athirst of the fountain of the water of life freely.

(계 21:27) And there shall in no wise enter into it any thing that defileth, neither whatsoever worketh abomination, or maketh a lie: but they which are written in the Lamb's book of life.

  

(계 22:1) And he shewed me a pure river of water of life, clear as crystal, proceeding out of the throne of God and of the Lamb.

(계 22:2) In the midst of the street of it, and on either side of the river, [was there] the tree of life, which bare twelve [manner of] fruits, and yielded her fruit every month: and the leaves of the tree [were] for the healing of the nations.

  

(계 22:14) Blessed are they that do his commandments, that they may have right to the tree of life, and may enter in through the gates into the city.

(계 22:17) And the Spirit and the bride say, Come. And let him that heareth say, Come. And let him that is athirst come. And whosoever will, let him take the water of life freely.

(계 22:19) And if any man shall take away from the words of the book of this prophecy, God shall take away his part out of the book of life, and out of the holy city, and from the things which are written in this book.
